Residential agreements can be from 11 month, 3 years to 5 years or more. Generally, people (both tenants as well as landlords) make a rental agreement for 11 months. This is done to avoid the stamp duty charges. However, there is no such rule that the residential rental agreement cannot be extended.
Can I give rental income to my son?
The parent (in the above example) may be content to transfer an interest in the property to the child, and to share the rental income between them. The gift of a property interest will generally be treated as a disposal at market value for capital gains tax (CGT) purposes.

One practical way in which to avoid such a situation would be to discuss matters with adult children (aged 21 and above) and consent to a family arrangement. If the children are under 21, the parent may need to consider other options. For example, the parent may wish to leave the property to such children on trust (see below).
